Can an RCFE Caregiver Feed a Resident?

One of the most common questions among California assisted living providers is: “Can RCFE caregivers feed a resident?” The answer is yes, caregivers can feed residents. Feeding has always been recognized as part of basic care and supervision under California’s Health and Safety Code, even though confusion still exists because of how Title 22 was written.

Under Health and Safety Code §1569.312 and §1569.2, every RCFE must provide care and supervision, which includes helping residents with personal activities of daily living (ADLs) such as dressing, bathing, toileting, grooming, and feeding. Feeding is defined as helping a resident eat, including placing food in the resident’s mouth if needed. This assistance has been legal and required since 1986. In fact, Title 22 §87411(c)(3)(B) requires all direct care staff to be trained in “bathing, grooming, dressing, feeding, toileting, and universal precautions.” If feeding were prohibited, it would make no sense for the law to require caregiver training in how to do it.

So where does the confusion come from? Title 22 uses the term “eating” instead of “feeding,” which caused many to assume that caregivers can only serve meals but not physically assist residents. That’s incorrect. RCFEs are legally required to provide personal care, and that includes feeding, when the resident is willing and gives express or implied consent (for example, by saying yes or opening their mouth). Refusing to feed a resident who needs help could actually be considered neglect under the law.

In short, RCFE caregivers can and must feed residents who need assistance, as long as it’s done safely and respectfully. Facilities should ensure that caregivers are trained and competent in feeding techniques, especially for residents with swallowing difficulties or other special needs.
